1. GENERAL INFORMATION

The website, www.kinto.be, has been developed by the Netoptic SA, whose registered office is located at 1480 Saintes, Avenue Landas, 13, and which is registered with the Crossroads Bank for Enterprises under the number 0413.838.127. 


2. ACCESS TO THE SITE

Access to the www.kinto.be website and/or its use is subject to users being fully aware of the present conditions and implies that they have automatically and unconditionally accepted the present Terms and Conditions, as amended.

Netoptic may at any time amend the present General Conditions, in particular in order to comply with any new regulations or legislation or in order to improve the use of the site for the user. Netoptic encourages users to consult the General Conditions frequently to stay up to date on any amendments and to comply with such amendments, where applicable.


3. INTELLECTUAL PROPERTY RIGHTS

The present site and the entirety of its contents, in particular, but not exclusively, the texts, trademarks, logos, graphics, images, drawings, illustrations, videos, audio extracts, photographs, page layout and other distinctive signs, together with the design, format, any databases and certain databases used on the site or in the newsletters are the property of Netoptic and/or are used under licence. None of these elements may be used in any way whatsoever without authorisation from Netoptic.

In return for acceptance of and compliance with the present General Conditions, Netoptic grants users a private, ad hoc, non-exclusive right of personal use on the protected works, for which it holds the intellectual property rights, unless otherwise agreed by Netoptic. Netoptic reserves the right to terminate this use at any time without notice or compensation. 

The user is authorised to download, present or print the content of the site solely for personal, non-commercial use and shall store and reproduce every notice of intellectual property rights included in the information or in any other material, which may be downloaded, unless otherwise agreed by Netoptic. This restriction shall apply irrespective of material or reproduction, representation and/or modification procedures and for any period whatsoever. Any unauthorised action shall constitute an offence of counterfeiting, punishable under criminal law.


4. USE OF THE WEBSITE

The user undertakes to use the information contained on this site in compliance with the present General Conditions and the law. In particular he undertakes not to commit unlawful acts on this site, which violate the rights and interests of third parties and/or could harm, overload or discredit the site or cause it to malfunction or to fail. The user undertakes not to commit any act nor to make any statements and not to take any action on this site, which could discredit Netoptic's name and image or its products.

The user shall refrain from sending or transferring in any way whatsoever any content, which could be deemed illegal, harmful, threatening, abusive, defamatory, vulgar, obscene or which constitutes harassment, threatens the private life of another, incites hatred or racial hatred or is otherwise harmful or is harmful in any way whatsoever to users under the age of majority.


5. PERSONAL DATA

Under this heading Netoptic refers the user to the Privacy Policy available in a later section of this page, www.kinto.be, which complies with the requirements of the General Data Protection Regulation for the protection of personal data.


6. LINKS TO OTHER SITES

Any creation of hyper-links with the www.kinto.be site is prohibited without the previous agreement of Netoptic.

The site gives access to other Netoptic sites and to sites of Neoptic's partners, by means of hypertexts or by integrating the contents of its partners' sites on this site. Although particular care and vigilance have been exercised in the choice of links to external Internet sites, Netoptic disclaims all liability for the content of these sites, for their legality, precision or function. Netoptic may not be held liable for any damage or loss, proven or alleged, arising from or relating to the use of the third-party sites.

The user is liable and shall incur all the risks regarding the use made by him of the site, which he has accessed by means of a hyper-link featured on this site, in particular when he relies on the advisability, usefulness or complete character of this content.


7. LIMITATION OF LIABILITY 

The user uses the site at his sole risk. On no account shall Netoptic be held liable for any direct or indirect damage (material loss, loss of data, financial loss, etc.), arising from access to or use of the present site or any of the sites linked to it.

Netoptic accepts no liability for any damage or virus, which may affect the user's computer or hardware as a consequence in particular of accessing or using the site, downloading elements from the site or of unlawful interference with computer systems.

Netoptic takes the greatest possible care to broadcast quality information on its site; however, it cannot give an absolute guarantee of the precision and exhaustive nature of this information. Therefore, Netoptic, which is subject to the duty of exercising its best endeavours, may not be held liable for any direct or indirect damage arising from the improper use of information or from inaccurate or incomplete information.

Netoptic undertakes to exercise its best endeavours to ensure that the site is accessible at all times to Internet surfers. However, in the event that the site is unavailable, Netoptic may not be held liable whatever the cause.


8. APPLICABLE LAW

The present conditions are governed by Belgian law. The courts in Brussels shall have sole jurisdiction over disputes arising from the content or the application of the present conditions. Netoptic reserves the right to take legal action against users, who behave in a manner deemed unlawful or in breach of the present conditions.
